Motion for the Protection of the Right to Strike

Moved : Seraphia Ember
Seconded: David Tsinovog

Whereas the Liberal government, through the Canada Industrial Relations Board (CIRB), has ordered postal workers back to work, forcing us to fold our picket lines and abandoning our leverage in bargaining; and

Whereas the right to strike is a constitutional right, and such orders infringe upon this fundamental right of workers; and

Whereas community groups, including other unions such as the International Longshore and Warehouse Union (ILWU), the Teamsters, the Industrial Workers of the World (IWW), and others affected by the CIRB’s actions, have organized picket lines in Vancouver and St. John to assert their solidarity and the importance of protecting workers’ rights; and

Whereas if the right to strike continues to be trampled upon, there may be significant consequences for workers’ ability to protect their jobs in the future; and

Whereas it is essential that our local engage with community groups, such as the ILWU, Teamsters, Toronto York District Labour Council, and other unions who have faced similar government actions, to defend the right to strike and escalate the class struggle in response to the government’s disregard for the working class; and

Whereas the right to strike was once illegal. All strikes were once illegal, but it was through the blood and sacrifice of workers that we won the right to strike, and now that the government has taken that away, it can only be responded to with the utmost urgency and gravity; and

Therefore, be it resolved that this local will:

1. Actively engage with community groups and unions affected by CIRB orders, including the ILWU, Teamsters, and the Toronto York District Council, to form a united front in the defense of worker’s rights;

  1. Commit to escalating efforts to challenge unjust government orders and protecting our right to strike as a cornerstone of the worker’s struggle;

  1. Work to build solidarity within the labor movement and broader community to resist further infringements on the right to strike and to ensure that workers have the means to defend their rights in the face of government overreach;
  2. Transparently engage with these groups, publish updates on their activities at least once a week, and work with the goal of explicitly establishing community picket lines at postal facilities to disrupt postal operations until such time as our right to strike is respected and the employer meets with us and settles a negotiated contract with no rollbacks and no concessions;

  1. Allow, encourage, and recognize the authority of each rank and file member to establish connections with the aforementioned community groups for the goals of this motions.

Dear Sisters, Brothers, and Friends,

Canada Post on December 12th, 2025 has again started to issue 44.11(a) termination letters to temporary workers. If you receive one, it is critical that you act immediately.

WHAT TO DO RIGHT AWAY:

  1. File a grievance without delay.
  2. Contact your Shop Steward at onceor call the Toronto Local Grievance Officer to arrange an in-person meeting at the Union Hall.
  3. Gather any documentationthat explains the reasons for your unavailability.
  4. Do not resign and do not accept termination.

Temporary workers are not disposable. You are essential, you are union, and you deserve fair treatment. Your rights are protected under the collective agreement—use them.

The Toronto Local is defending your rights.

CUPW is filing grievances, challenging violations, and pushing back against unfair treatment.

Solidarity means every worker counts.

We will not allow Canada Post to divide us.  We will not remain silent while temporary workers are used, mistreated, or pushed aside.

An injury to one is an injury to all—and the Toronto Local will fight for every single member.

In Solidarity and In Strength

Sisters, Brothers and Siblings:

With Christmas right around the corner, I would like to take this opportunity to wish all of you and your families a Merry Christmas/Happy Holidays and a very Happy, Healthy and Peaceful New Year.

The resilience and strength in the face of challenges we have faced truly inspired all Postal Workers and our National Negotiators.

As we spend this Christmas and New Year holiday with loved ones, take a moment to reflect on gratitude and unity.

President,
